1. Introduction

Welcome to Rox Accommodation Pty Ltd (“Rox Accommodation,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website and the accommodation services we provide.

By accessing our website, making a booking, or residing in one of our properties, you agree to be bound by:

  • These Terms and Conditions

  • The Licensee Agreement

  • The House Rules

Together, these documents form a legally binding agreement between you (the “Licensee”) and Rox Accommodation.


2. Nature of the Agreement

All bookings with Rox Accommodation constitute a license to occupy a shared-use bed or space within a property. This license:

  • Does not grant exclusive possession

  • Does not constitute a lease or tenancy

  • Is personal, non-transferable, and revocable

  • Is governed by contract law, not the Residential Tenancies Act 2010 (NSW)

If a court or tribunal determines this arrangement to be a residential tenancy, both parties agree to interpret the agreement in a way that preserves the Lessor’s contractual rights to the fullest extent permitted by law.


3. Minimum Stay and Replacement Policy

  • A minimum stay of three (3) months applies to all bookings.

  • If a Licensee intends to vacate after completing the 3-month minimum stay, they must provide at least 3 weeks’ written notice prior to the intended move-out date.

  • If the intended move-out date falls within a Replacement Period, the Licensee is not required to provide a replacement, provided that:

    • They have completed the full 3-month minimum stay, and

    • They have given at least 3 weeks’ written notice before reaching the 3-month minimum stay date.

Replacement Periods

These are high-demand times during which a replacement Licensee is otherwise required:

  • 1 June to 30 September

  • 1 December to 31 January

  • Licensees who:

    • Wish to vacate before completing the 3-month minimum stay, or

    • Vacate during a Replacement Period without meeting the conditions above,

    must provide a replacement Licensee who:

    • Is approved by Rox Accommodation

    • Is not currently residing in any Rox Accommodation property

    • Will begin a new 3-month agreement on the same day the outgoing Licensee vacates

  • Failure to meet the replacement conditions when required will result in forfeiture of the Bond (Security Deposit).


4. Payment Terms

  • Rent is payable fortnightly in advance via electronic funds transfer (EFT) only.

  • Cash payments are not accepted.

  • Late payments will incur a fee as detailed in the Licensee Agreement

  • If rent remains unpaid for 4 days, your agreement may be terminated immediately and your Bond forfeited.

  • Rent is strictly non-refundable, even if you vacate early.


5. Cancellations

Cancellations made more than 4 weeks prior to the move-in date:

  • Clients are eligible for a full refund of the Bond.

Cancellations made 4 weeks or less prior to the move-in date:

  • The entire Bond will be forfeited, and no refund will be issued.

This policy applies regardless of reason and forms part of the binding agreement upon booking.


6. Bond (Security Deposit)

  • A Bond equal to two (2) weeks’ rent must be paid prior to check-in.

  • The Bond is held as a security deposit and may be used to cover:

    • Damage beyond fair wear and tear

    • Unpaid rent, fines, or cleaning fees

  • The Bond is not to be used for rent during the stay or final rent upon vacating.

  • Subject to compliance, the Bond will be refunded via bank transfer within 3 days of check-out.


7. House Rules Compliance

All Licensees must comply with the Rox Accommodation House Rules, which form part of your binding agreement. These include rules on:

  • Cleanliness & hygiene

  • Quiet hours & noise restrictions

  • Prohibited items & conduct

  • Guest policy

  • Safety and fire regulations

  • Moving out procedures

  • Utilities and fair use

Breaches may result in:

  • Fines will be applied as outlined in the House Rules

  • Deductions from the Bond

  • Immediate termination of the license


8. Termination & Vacating

a) By Rox Accommodation:

We may terminate your license:

  • With 2 weeks’ written notice, for any reason

  • Immediately, for serious breaches (e.g. violence, illegal conduct, non-payment, damage)

b) By the Licensee:

You may vacate:

  • After 3 months, with 3 weeks’ written notice

  • Earlier, only if you comply with the Replacement Licensee requirement during the Replacement Period

You must:

  • Pay rent up to and including the notice period

  • Leave the premises clean and undamaged

  • Return all keys, swipes, and access cards

  • Remove all personal belongings

Failure to follow the Moving Out Procedure may result in a deduction from your Bond, as outlined in the House Rules.


9. Access, Inspections & Entry

Rox Accommodation or its authorized agents may enter the premises:

  • For inspections, maintenance, or repairs

  • With prior notice, except in emergencies

  • To show the property to prospective Licensees

The property may also be inspected by landlords or real estate agents in accordance with applicable laws.

Licensees may be asked to temporarily vacate the property during such inspections.


10. Utilities – Fair Use Policy

Electricity, gas, water, and internet are included in the rent and provided under a Fair Use Policy.

Utilities are for reasonable residential use only. Rox Accommodation may monitor consumption, and if usage exceeds acceptable limits over any 3-month period, additional charges may apply. These charges will be shared equally among all Licensees at the property.

Usage thresholds and excess rates are detailed in the House Rules.

By entering this agreement, you agree to use utilities responsibly and to cover any excess usage fees as required.


11. Prohibited Items and Behaviour

The following are strictly prohibited:

  • Illegal drugs or drug use

  • Smoking indoors

  • Pets of any kind

  • Overnight guests

  • Parties, functions, or gatherings

  • Portable heaters, air conditioning units, or BBQs

  • Mini-fridges in bedrooms

  • Sticking or attaching items to walls/furniture

Violations may result in fines, Bond deductions, or immediate eviction.


12. Liability

  • Licensees are solely responsible for their personal belongings.

  • Rox Accommodation is not liable for loss, theft, or damage to personal property under any circumstances.

  • Licensees are liable for any damage they cause. If individual responsibility cannot be established, costs may be shared among all residents.


13. Dispute Resolution

If a dispute arises:

  1. Parties must first attempt to resolve the matter amicably

  2. If unresolved, the matter will be referred to mediation with a mutually agreed independent mediator

  3. Mediation costs are shared equally

  4. If mediation fails, the dispute may proceed to a court or tribunal with appropriate jurisdiction

Licensees remain bound by the agreement and must continue fulfilling all obligations during the dispute process.


14. Modifications to Terms

Rox Accommodation reserves the right to update, modify, or replace these Terms at any time.

Changes will be communicated via:

  • Website updates

  • Email or SMS notice

Continued use of our services constitutes acceptance of the updated Terms.


15. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and any disputes are subject to the jurisdiction of its courts and tribunals.


16. Acceptance

By using our website, making a booking, or residing in one of our properties, you confirm that you have read, understood, and agree to be legally bound by:

  • These Terms and Conditions

  • The Licensee Agreement

  • The House Rules
